Member Agreement

About this agreement

1. Your use or play of Cybots (the 'Service') provided by 4 Point Games (in this agreement referred to as 'we' or 'us') is subject to the terms and conditions set out in this agreement. You must read these terms and conditions carefully. By using the Service you agree to be bound by the terms and conditions set out in this agreement. Only persons 18 years of age or over are eligible to become members of the Service. You promise us that you are over the age of 18 years. This agreement takes effect immediately upon the first time you log into the Service and continues until terminated by either of us.

What we must do

2. We will do our best to provide you with the Service after you have registered and payed any applicable fees. That is, by using the Service you accept full responsibility for all and any information that you transmit via the Service. It should be noted that the numbers of players permitted to use the Service is entirely at our discretion. It should further be noted that, at any time, the Service may be ‘down’, have ‘bugs’, may not work according to specification. Whilst we will use all reasonable endeavours to remedy such events, we will not be liable for these events and any remedies will be made at our discretion. We do not check the content of information accessed using the Service, and we are not liable for any loss or damage which you or anyone else suffers as a result of using such information. You acknowledge that some of the content accessible on the Service may be unsuitable for minors and you warrant that no minor will use the Service without your express permission and under your personal control and supervision.

What you must do
3. You are responsible for all telecommunication fees or charges to connect to the Service. You are responsible for acquiring and maintaining all equipment, services and software necessary to access the Service.

What you must not do
4. You must not resell or onsell the Service or any part of it, or permit any other person, other than an adult member of your household or others with your express permission and under your personal control and supervision, to use or access the Service. You accept full responsibility for all use of the Service by all persons using your account. You must not use the Service for any activities which breach any laws or infringe any of our rights or the rights of any third party, or breach any standards, content requirements or applicable codes which may be accessed via the Service). You must not use the Service in a way that interferes with its availability to any other user. You must not use the Service to defame, harass or menace any other person. You indemnify us from and against all actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected with use of the Service by persons using your account. If you breach any of the terms or conditions set-out in this agreement we may suspend or terminate your access to the Service without notice and without refund. Contributions, Donations or Fees paid for any subscription term or pay-per-use are paid in advance and are not refundable in whole or in part. You cannot and must not assign or attempt to assign your rights under this agreement.

Liability under this agreement

5. Our liability for negligence, breach of contract or contravention of any law as a result of any problem with the Service that cannot be lawfully excluded will be limited to resupplying the Service to you. To the full extent permitted by law we exclude all conditions or warranties that may be implied into this agreement. However, under certain laws you may still possess rights that we may not exclude.

Ending this agreement

6. Either party may end this agreement at any time by giving the other party 24 hours notice. Contributions, Donations or Fees paid for any subscription term or pay-per-use are paid in advance and are not refundable in whole or in part. Ending this agreement does not affect the provisions regarding indemnity or limitation of liability.

General conditions

7. We may assign or novate this agreement by giving you notice in writing. We may vary these terms and conditions at any time. If we do vary them we will use reasonable efforts to notify you that they have changed. We will also place the new terms and conditions on our website. If we vary these terms and conditions, your use of the Service after the variation will be taken as acceptance by you of the changed terms and conditions. Notices under this agreement by email. Notices will be properly served if sent to the last known email address and will be deemed to have been received on the day they are sent. This agreement is governed by the law in force in the State of New South Wales, Australia and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and courts of appeal from them for determining any dispute concerning this agreement.


Code of Conduct

These are some commonsense guidelines that are appropriate for any service where strangers can meet semi-anonymously:
a. Online, people are not always who they appear to be or say they are. You may put yourself at risk if you arrange to meet in person the people you meet on the Service.
b. Please do not give out your real name, address or telephone number or ask anyone to give them to you.
c. If you do meet up with other people you meet on the Service, never go on your own, always meet in a public place (never arrange to meet at someone's home address), and tell someone where you are going, and what time you will return. Make your own travel arrangements to and from any venue.


Whilst using the Service, you must not do any of the following:

1. Display pornographic material or links to pornographic websites
Action we may take: Permanent ban from the Service.

2. Use or display illegal or pirated software material or links to pirated software websites Action we may take: Permanent ban from the Service.

3. Display links to third party websites relating to cheats for use in multiplayer gaming Action we may take: Permanent ban from the Service.

4. Use cheats during multiplayer games Action we may take: Permanent ban from the Service.

5. Abuse other players, 4 Point Games staff, administrators or Game operators in a racially and sexually defamatory manner Action we may take: Permanent ban from the Service.

6. Abuse other players, 4 Point Games staff, administrators or Game Operators with obscene, abusive intimidating language Action we may take: Permanent ban from the Service.

7. Falsely accuse other players of cheating for the purpose of discrediting an innocent player Action we may take: Permanent ban from the Service.

8. Use inappropriate names and name tag stealing Definition: Using foul or racially/sexually discriminatory language in a player's online nickname or clan tag. Using another player's name with purpose of discrediting their online name. Impersonating a Game Operator /Administrator /4 Point Games staff member. Action we may take: Permanent ban from the Service. We may also notify your ISP.

Messageboards

You must not post material containing the following items on Cybots or ANY OTHER 4 Point Games operated messageboards;
a. Pornography or links to pornography sites;
b. Racially defamatory material;
c. Material defamatory to an individual, group, company or organisation;
d. Material containing foul or abusive language;
e. Material a court might consider libellous;
f. Material that is the intellectual property of a third party without legally obtaining satisfactory consent from the owner;
g. Links to third party websites containing illegal or pirated software; or
h. Links to third party websites relating to cheats for the use in online multiplayer gaming.

4 Point Games is not obligated to take any action in relation to any prohibited conduct mentioned above. Any action we do or do not take will be at the absolute discretion of 4 Point Games.
